Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you and Greyalytics, LLC, a Texas limited liability company ("Calm Tales," "we," "us," or "our") governing your use of the Calm Tales service at mycalmtales.com and calmtales.ai.

By creating an account or using our service, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference.

By accessing and using Calm Tales, you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.

These Terms, together with our Privacy Policy, form a binding legal agreement. If you do not agree to all terms, you must not access or use our service.

Age Requirement: Calm Tales is intended for use by parents and guardians only. You must be at least 18 years of age to create an account and use this service. By creating an account, you represent and warrant that you are 18 or older and have the legal capacity to enter into this agreement.

Calm Tales provides an AI-powered bedtime story generation service designed specifically for children with autism and sensory processing differences. Our service includes:

• Personalized story creation based on child profiles
• AI-generated watercolor-style illustrations
• Story collection management and storage
• Therapeutic story elements designed with calming principles

Beta Service

Calm Tales is currently offered as a FREE BETA service. We are actively developing and testing features. As a beta user, you understand that:

• The service may contain bugs or errors
• Features may change without notice
• Service availability may be limited or interrupted
• We may add paid subscription plans in the future (with advance notice to existing users)

We reserve the right to modify, suspend, or discontinue any aspect of the service at any time with reasonable notice.

Calm Tales is currently FREE for all users. We plan to introduce optional paid subscription plans in the future to unlock premium features.

What This Means

• Current beta users will be moved into a free tier
• Paid plans will offer additional features (higher usage, more stories, advanced customization, etc.)
• You will NEVER be required to pay to continue on the free tier
• You will NEVER be charged without explicitly signing up for a paid plan

When We Add Paid Plans

• We'll announce new features and pricing
• Free tier will continue to exist
• You choose whether to upgrade (completely optional)
• Your existing stories and data remain accessible

We'll provide advance notice before launching paid plans, but you will continue on a free plan and maintain your current stories.

To use Calm Tales, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity.

You agree not to use Calm Tales for any unlawful purpose or in any way that:

• Violates any applicable laws or regulations
• Infringes on intellectual property rights
• Attempts to access unauthorized areas of the service
• Distributes malware or harmful code
• Scrapes, copies, or attempts to reverse engineer the service
• Resells or commercially exploits the service
• Creates multiple accounts to abuse the free service
• Uses automated tools or bots to access the service
• Interferes with or disrupts the service or servers
• Impersonates others or misrepresents your affiliation

Our Property

Calm Tales, including all software, code, graphics, designs, text, logos, trademarks, and branding, is owned by Greyalytics, LLC and protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the service for personal purposes only. You may not:

• Copy, modify, or distribute our software or service code
• Use our trademarks, logos, or branding without written permission
• Remove or alter any copyright, trademark, or proprietary notices
• Reverse engineer, decompile, or disassemble our service
• Create derivative works based on our service

AI-Generated Stories

Stories and images generated through Calm Tales are created using AI technology (Google Gemini API). You are granted a personal, non-exclusive, non-commercial license to use generated content for family purposes only.

You may:

• Print stories for personal family use
• Share with immediate family members
• Read stories to your children
• Save stories to your account

You may NOT:

• Publish stories commercially (books, websites, apps)
• Redistribute stories on public platforms or social media
• Claim authorship of AI-generated content
• Use stories for any commercial purpose without written permission
• Mass-produce or sell stories

Your Personal Information

We do not claim ownership of the personal information you provide (child's first name, preferences, etc.). However, by using our service, you grant us permission to use this information to generate personalized stories.

Feedback and Suggestions

If you provide suggestions, ideas, feedback, or recommendations about Calm Tales, you grant us a perpetual, worldwide, royalty-free license to use that feedback to improve our service without any obligation to compensate you.

Termination By You

You may delete your account at any time through your account settings or by contacting support@mycalmtales.com.

Upon voluntary deletion:

• Your account will be deactivated immediately
• Your data will be deleted within 30 days per our Privacy Policy
• You may request an export of your stories before deletion

Termination By Us

We reserve the right to suspend or terminate your account immediately if you:

• Violate these Terms or our Privacy Policy
• Engage in fraudulent, illegal, or abusive activity
• Abuse or misuse the service
• Create multiple accounts to circumvent restrictions
• Use the service in a way that harms Calm Tales or other users

Effect of Termination

Upon termination for any reason:

• Your right to access and use the service immediately ends
• You must cease all use of Calm Tales content and materials
• We may delete your account data per our Privacy Policy (within 30 days)
• Sections of these Terms that should survive (limitation of liability, dispute resolution, intellectual property, indemnification) will remain in effect

We will attempt to provide notice before termination except in cases of serious violations or legal requirements.

Important Medical Disclaimer

Calm Tales provides bedtime stories designed with therapeutic principles to promote relaxation and calm. However, Calm Tales is NOT a medical, mental health, or therapeutic service.

Calm Tales is NOT:

• A substitute for professional medical advice, diagnosis, or treatment
• A replacement for therapy, counseling, or behavioral intervention
• Supervised, reviewed, or approved by medical professionals for treatment purposes
• Intended to diagnose, treat, cure, or prevent any medical condition
• A substitute for prescribed medications or treatments

You Should:

• Always consult qualified healthcare providers for medical or therapeutic advice
• Continue any prescribed treatments, therapies, or medications
• Seek immediate professional help if your child is in crisis or experiencing distress
• Not rely on Calm Tales as your sole intervention for any behavioral or medical concern

We Make No Claims or Guarantees:

• That our stories will cure, treat, improve, or prevent any medical or behavioral condition
• About the effectiveness of our stories for specific individuals or conditions
• About specific outcomes or results from using our service
• That our service is appropriate for all children or situations

By using Calm Tales, you acknowledge that you understand these limitations and agree to use our service as a supplementary tool only, not as professional medical care or therapeutic treatment. You assume all risks associated with using our service.

If you have concerns about your child's health, development, or behavior, please consult qualified healthcare professionals.

"AS IS" Service

Calm Tales is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• That the service will be uninterrupted, error-free, or secure
• That defects will be corrected
• That the service or servers are free of viruses or harmful components

No Liability For

To the fullest extent permitted by law, Greyalytics, LLC and its officers, directors, employees, agents, and affiliates are not liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, use, or goodwill
• Service interruptions, errors, or delays
• Unauthorized access to or alteration of your data
• Third-party conduct or content
• Any damages arising from use or inability to use the service
• Technical failures (internet, hosting, servers, software)
• Loss of data due to technical issues or service termination

Limited Liability Cap

Our total liability to you for all claims related to the service is limited to $100.

Third-Party Services

We are not responsible for the performance, errors, or data practices of third-party services including Google Cloud Platform, Firebase, Google Gemini AI, or payment processors.

These limitations apply even if any remedy fails of its essential purpose. Some jurisdictions do not allow limitation of certain warranties or damages, so some limitations may not apply to you.

You agree to indemnify, defend, and hold harmless Greyalytics, LLC, its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees and costs) arising from or related to:

• Your use or misuse of the service
• Your violation of these Terms or our Privacy Policy
• Your violation of any law, regulation, or third-party rights
• Content you provide to the service (child information, preferences, etc.)
• Any claim that your use of the service harmed a third party
• Unauthorized use of your account by someone who obtained access through your failure to safeguard your credentials

This indemnification obligation survives termination of your account and these Terms. We reserve the right to assume exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with our defense.

Informal Resolution First

Before filing any legal claim, you agree to first contact us at support@mycalmtales.com to attempt to resolve the dispute informally. We will work in good faith to resolve disputes for at least 60 days before either party may commence arbitration or litigation.

Binding Arbitration

If we cannot resolve a dispute informally, you agree that any dispute, claim, or controversy arising out of or relating to these Terms, our Privacy Policy, or our service will be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, rather than in court.

Exceptions

Either party may:

• Bring an individual action in small claims court if the claim qualifies
• Seek injunctive or equitable relief in court to protect intellectual property rights or prevent unauthorized use of the service

Arbitration Rules

• Arbitration will be conducted by a single arbitrator
• Arbitration will take place in Texas or via videoconference
• The arbitrator's decision will be final and binding
• Each party pays their own legal fees and costs unless the arbitrator decides otherwise
• The arbitrator may award the same damages and relief as a court
• Discovery will be limited as determined by the arbitrator

Class Action Waiver

You agree to resolve disputes with us only on an individual basis and waive any right to participate in class actions, class arbitrations, or representative actions. You may not consolidate claims with other users or bring claims on behalf of others.

Opt-Out Right

You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing support@mycalmtales.com with "Arbitration Opt-Out" in the subject line, along with your name and account email. If you opt out, all disputes will be resolved in court as described in "Governing Law" below.

Changes to Arbitration

If we make material changes to this arbitration provision, you have 30 days to reject the changes by emailing us. Your rejection does not affect other provisions of these Terms.

These Terms and your use of the service are governed by the laws of the State of Texas, United States, without regard to its conflict of law principles.

To the extent arbitration does not apply (including if you opt out or for claims in small claims court), you agree that:

• Any legal action or proceeding must be brought exclusively in the state or federal courts located in Texas
• You consent to personal jurisdiction and venue in those courts
• You waive any objection to jurisdiction or venue in those courts

The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.

Note: If you are a consumer in the European Union, you may have certain rights under EU law that cannot be waived by this provision.

Calm Tales integrates with and relies on third-party services to provide our service:

Third-Party Providers

• Google Cloud Platform / Firebase: Data storage, authentication, and hosting
• Google Gemini AI: AI-powered story and image generation
• Cloud Storage: Google Cloud Storage for images and files

Your Agreement

Your use of these third-party services through Calm Tales is subject to their respective terms of service and privacy policies. We encourage you to review:

Our Responsibility

We are not responsible for:

• Third-party service outages, errors, or performance issues
• Third-party data practices (though we select reputable providers)
• Changes to third-party terms, pricing, or availability
• Third-party service interruptions beyond our control

We reserve the right to change third-party service providers with reasonable notice to maintain or improve our service quality.

We are not liable for any failure or delay in performing our obligations under these Terms when the failure or delay is due to events beyond our reasonable control, including:

• Natural disasters (earthquakes, floods, hurricanes, fires)
• War, terrorism, riots, or civil unrest
• Government actions, laws, regulations, or orders
• Strikes, labor disputes, or shortages
• Internet, telecommunications, or utility failures
• Third-party service provider outages (Google Cloud, Firebase, etc.)
• Epidemic, pandemic, or public health emergency
• Cyberattacks, data breaches affecting third-party infrastructure
• Any other causes beyond our reasonable control

During force majeure events:

• Our obligations under these Terms are suspended for the duration of the event
• We will use commercially reasonable efforts to minimize service disruption
• We will provide notice when reasonably possible

If a force majeure event continues for more than 30 consecutive days, either party may terminate the agreement upon written notice.

We may update these Terms from time to time to reflect changes in our service, business practices, or legal requirements.

How We Notify You

When we make changes to these Terms:

• We will update the "Last Updated" date at the top of this page
• For material changes, we will send email notification to your registered email address at least 30 days before the changes take effect
• For significant changes affecting your rights, we may require you to affirmatively accept the new terms before continuing to use the service

Your Options

• If you agree to the updated Terms, continue using the service after the effective date
• If you do not agree, you must stop using the service and may delete your account
• For material changes, you may export your data before the changes take effect

Your continued use of Calm Tales after updated Terms take effect constitutes your acceptance of the changes. If you do not agree to updated Terms, your sole remedy is to stop using the service and delete your account.

We encourage you to review these Terms periodically to stay informed of any updates.

Entire Agreement

These Terms, together with our Privacy Policy and any other policies or agreements referenced herein, constitute the entire agreement between you and Greyalytics, LLC regarding Calm Tales. They supersede all prior agreements, communications, proposals, and understandings, whether oral or written.

Severability

If any provision of these Terms is found to be unenforceable, invalid, or illegal by a court or arbitrator, that provision will be limited or eliminated to the minimum extent necessary so that these Terms otherwise remain in full force and effect.

No Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. Any waiver of any provision must be in writing and signed by an authorized representative of Greyalytics, LLC.

Assignment

You may not assign, transfer, or delegate these Terms or your rights and obligations without our prior written consent. We may assign these Terms without restriction, including to any successor or affiliate. Any attempted assignment in violation of this provision is void.

Relationship

These Terms do not create any agency, partnership, joint venture, employment, or franchising relationship between you and Greyalytics, LLC. You have no authority to bind us or make representations on our behalf.

Headings

Section headings in these Terms are for convenience only and do not affect the interpretation of these Terms.

No Third-Party Beneficiaries

These Terms are for the benefit of you and Greyalytics, LLC only. No other person or entity has any rights under these Terms.

Language

These Terms are drafted in English. Any translations are provided for convenience only. In the event of conflict, the English version controls.

Survival

Provisions that by their nature should survive termination will survive, including: Intellectual Property Rights, Indemnification, Limitation of Liability, Dispute Resolution, Governing Law, and General Provisions.

Any notices or communications required under these Terms may be sent via email to support@mycalmtales.com. Notices sent by email are deemed received 24 hours after sending.

For notices to you, we will use the email address associated with your account. You are responsible for keeping your email address current.
